In 2021 was sent a contract for Temecula location after a zoom interview and the next day this soft spoken doctor owner called and said that “he needed me to work in Bakersfield location” (4 hours away) = Bait & Switch. So I walked away. In 2022 was offered another contract for same Temecula location. My contract lawyer reviewed this contract and asked for 3 items to be changed back to the “original verbal & email offers” from the in-house recruiter as I was originally told/emailed that full-time was only twelve (12) hour shifts/month so I was surprised to see on page 2 of 10, Section 1.3 Time and Place for Performing Services, that he had increased the required minimum guarantee of “twelve” 12 hour shifts/month to “fourteen” 12 hour shifts/month (without discussing with me) —- but he forgot to change the numbers inside the parentheses (12) to match the new word “fourteen” that he had increased. Thank God that I had a lawyer review it ! The lawyer also pointed out Section 3.3 Indemnity (also on page 4 of 10) which did not cover me for any Vendors - but protected him as did his request that I “incorporate myself” so that all Federal and State taxes would be on me. Upon receipt of “Updated contract” in an email, I was told that I was NOT going to get the $500 medical a month (that was spelled out in Section 2.5 Health Insurance (page 4 of 10) of HIS ORIGINAL CONTRACT. When I sent him the screen shots of his CONTRADICTIONS of his OWN ORIGINAL contract and emails from his OWN in-house recruiter that he sent me a voice memo saying that “you’re obviously getting confused between being an independent contractor” (that was spelled out in Section 1.5 Status of Physician - Independent Contractor) and being an employee —which told me that he had “OBVIOUSLY” tried pulling another Bait & Switch” — and that was 2 strikes and HE was out a potential independent contractor !!
In my opinion, it has always been worth paying an “EMPLOYMENT LAW” lawyer $350-$400 to review these employment contracts. Or these guys get away with deception.
